Terms of service
Last updated October 25, 2026
These terms of service (“Terms”) are an agreement between you and the operator of Qualifical (“Qualifical”, “we”, “us”, “our”), available at https://qualifical.com, through its API and MCP server, and through its browser extension (together, the “Service”). By creating an account, buying a plan or credits, or otherwise using the Service, you agree to these Terms and to our privacy policy. If you use the Service on behalf of an organization, you agree to these Terms for that organization and confirm that you have the authority to do so. If you don’t agree, don’t use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. If you are under the age of majority where you live, you may use it only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf. To buy a plan or credits, you must be able to enter into a binding contract.
2. Your account
You sign in with a link sent to your email address or with a Google account. Give accurate information, keep access to that email address or account secure, and don’t share your account with others. You are responsible for activity under your account and under any API keys you create. Tell us at support@qualifical.com if you believe your account or a key has been used without your permission.
3. The Service
Qualifical estimates how likely passages of a text are to read as AI-generated, and can rewrite passages so they read more naturally. You can write or import documents, check them, review suggested rewrites, keep or undo them, export your work, and use the same features through the API.
Detection scores are statistical estimates, not proof of how a text was written. They can be wrong, especially for short texts, heavily edited text, and writing by non-native speakers. Don’t rely on them alone to make decisions that affect a person, such as grading, hiring, or disciplinary action.
We may change, add, or remove features to improve the Service or to comply with law. If a change removes something material from a paid plan during a period you’ve paid for, we’ll tell you in advance where reasonably possible. We aim to keep the Service available but don’t guarantee that it will be uninterrupted or error-free.
4. Your content
You keep all rights to the text and files you add to the Service (“Your Content”). You give us a limited, worldwide, non-exclusive license to host, store, copy, process, and transmit Your Content only as needed to provide the Service to you, including sending it to the providers that check and rewrite it on our behalf, as described in the privacy policy. This license ends when you delete Your Content or your account, except for copies in backups that are deleted on their normal schedule, and except for training as described next.
While your account is free (with no plan and no bought credits that haven’t expired), you also give us a worldwide, non-exclusive, royalty-free license to keep, copy, and use Your Content, including text you send through the API, the MCP server, or the browser extension, and its scores and rewrites, to train, evaluate, and improve our models and the Service. This license covers the redacted samples described in the privacy policy for as long as it says we keep them, at most two years, and continues for models already trained or evaluated with them. It is subject to your right to object described there. Content you add while on a plan or holding bought credits is never used for training.
You confirm that you have the rights needed to add Your Content and to let us process it this way, and that it doesn’t break the law or anyone else’s rights. We may remove content or restrict access if we’re required to by law or reasonably believe it breaks these Terms.
5. Rewrites and other output
Rewrites are produced automatically by AI systems. They can be inaccurate, change your meaning, or resemble other text. Review every rewrite before you keep or use it; you are responsible for the text you keep and for how you use it. As between you and us, you own the rewrites of Your Content, to the extent the law allows. We don’t guarantee that any text, rewritten or not, will receive a particular score from Qualifical or from any other tool.
6. Acceptable use
You agree not to use the Service to:
- submit work as your own, or misrepresent how a text was produced, where your school, employer, publisher, or another rule you’re bound by prohibits it;
- create or spread content that is unlawful, defamatory, harassing, hateful, or deceptive, or that infringes someone else’s intellectual property, privacy, or other rights;
- impersonate anyone, commit fraud, or produce spam, phishing, or other misleading material;
- get around credit limits or rate limits, create multiple accounts or share an account to pool credits, or resell or redistribute access to the Service without our written permission;
- access the Service by automated means other than the API, scrape it, or interfere with, overload, probe, or attack it, its providers, or other users;
- copy, modify, reverse engineer, or decompile the Service, except where the law allows it despite this restriction; or
- upload malware or anything designed to harm systems or data.
You are responsible for following any rules on AI-assisted writing that apply to you, such as those of your school, employer, or publisher.
7. The API
API keys are for your own use. Keep them confidential and revoke any that may have been exposed. API requests spend the same credits as your account and are subject to rate limits described in the API documentation. We may revoke keys or limit API access that threatens the Service or breaks these Terms. Text you send through the API is processed to return a result and isn’t stored as a document. The same applies to the MCP server, to apps you connect to your account through it, which act for you and spend your credits until you disconnect them in Settings, and to text you check with the browser extension.
8. Plans, credits, billing, and renewal
The Service runs on credits: checking a word costs 1 credit and rewriting one costs 7, as shown with the plans and credit packs on the pricing page. Prices are in US dollars, before any sales tax or VAT. The free plan includes credits each calendar month (UTC), which reset on the 1st and don’t roll over. They’re also limited per day, per account and across all free accounts together; past either limit, anything paid for with free credits pauses until 00:00 UTC. We may change the free plan’s credits and limits at any time.
Paid plans (Plus, Pro, and Ultra) give credits for each monthly billing period once its payment succeeds; unused plan credits end with the period. Credit packs are one-time purchases of credits that last 365 days from purchase. Credits that run out soonest are spent first. Credits have no cash value, can’t be transferred, and aren’t refunded when they expire.
You can invite friends with the link on the Billing page. When an account made through your link makes its first check, it and you each get invite credits; when it first pays for a plan or credits, you get more once that payment can no longer be refunded. The amounts, how long the credits last, and the monthly limit are shown there. Invite credits are free credits, so the daily limits above apply to them, and a payment’s reward is taken back if the payment is later refunded or disputed. Inviting yourself, for example through accounts you make for that purpose, isn’t allowed, and neither is sending invite links as spam; we may withhold or take back invite credits earned that way. We may change or end invite rewards at any time; credits already given stay until they expire.
Orders are processed by Creem (creem.io), our Merchant of Record and the seller of record for all purchases. Creem handles payment, applicable sales tax and VAT, invoices, refunds, and chargebacks, and your purchase is also subject to Creem’s terms. Charges appear on your statement as “CREEM.IO* STORE”. We never see or store your full payment details.
Plans are subscriptions that renew automatically every month and are charged to your payment method at the start of each period until you cancel. You can cancel at any time on the Billing page, from the menu next to Manage billing. Cancelling stops future renewals; you keep your plan and its credits until the end of the period you’ve paid for, and your account then returns to the free plan. If a payment fails, Creem may retry it, and we may move your account to the free plan if it can’t be collected.
Moving to a higher plan takes effect at once: you’re charged the difference in price for the rest of the current period, and you get the higher plan’s extra credits for the same share of it. Moving to a lower plan takes effect at your next renewal: you keep the current plan’s credits until the period ends, and nothing is refunded for it.
We may change the prices of plans and credit packs. A new plan price applies from your next renewal, and we’ll tell you by email at least 30 days before it does, so you can cancel first; a pack costs what it shows when you buy it. Refunds are covered by our refund policy.
9. Suspension and termination
You can stop using the Service at any time, and you can delete your account in Settings; if your plan would still renew, cancel it first. Deleting your account ends any credits left on it. Deleting your account permanently deletes Your Content and your account data, as described in the privacy policy, except your email address, which we keep so it can’t open a new free account. To use that address with the Service again, write to support@qualifical.com.
We may suspend or close your account, with notice where reasonably possible, if you materially or repeatedly break these Terms, if your use creates risk or legal exposure for us, other users, or our providers, or if we are required to by law. If we close a paid account without cause, we’ll refund the unused part of the current period and the unspent credits of packs that haven’t expired. Sections 4, 5, and 10 to 16 continue to apply after your account ends.
10. Our intellectual property
The Service, including its software, design, and the Qualifical name and logo, belongs to us or our licensors and is protected by law. These Terms give you a personal, non-exclusive, non-transferable, revocable right to use the Service as described here; they don’t give you any other rights in it. If you send us feedback or suggestions, we may use them without any obligation to you.
11. Third-party services
Analytics is optional and uses Google Analytics 4 and Google Ads to understand website usage and measure registrations and purchases. Accepting these Terms does not authorise Analytics: those services remain blocked until you separately allow it. You can reject or withdraw consent through Cookie preferences in our privacy policy without losing access to the Service. The privacy policy explains the events, cookies, recipients and data safeguards.
The Service relies on third parties, including Google for sign-in, Creem for payments, and the providers that host the Service and check and rewrite text. Your use of their services may also be subject to their terms. We aren’t responsible for third-party services we don’t control.
12. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. In particular, we don’t warrant that detection scores are correct or that rewrites are accurate, original, or suitable for your purpose.
13. Limitation of liability
To the extent permitted by law, we won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or academic or professional standing, arising out of or relating to the Service, even if we were told such damages were possible. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim and US$50.
Nothing in these Terms excludes or limits liability that can’t be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence. If you are a consumer, you also keep the rights the consumer law of your country gives you, which these Terms don’t override.
14. Indemnity
To the extent permitted by law, you agree to indemnify us against claims, losses, and reasonable costs, including legal fees, brought by third parties and arising from Your Content or your breach of these Terms. This section doesn’t apply to consumers where the law doesn’t allow it.
15. Governing law and disputes
These Terms are governed by the laws of the place where the operator of Qualifical is established, without regard to its conflict-of-law rules. If a dispute arises, both of us will first try in good faith to settle it by negotiation: contact us at support@qualifical.com, and we’ll respond within 30 days. If it isn’t settled within 60 days of your message, either of us may submit it to binding arbitration conducted online. If you are a consumer, you also keep any mandatory protections of the law of the country where you live, including any right to bring proceedings in its courts, and nothing in this section takes them away.
16. Changes to these terms
We may update these Terms, for example to reflect changes to the Service or the law. We’ll post the new version here with a new date and, if a change is material, tell you by email or in the Service at least 14 days before it takes effect. If you keep using the Service after that, the new Terms apply; if you don’t agree, stop using the Service and delete your account before then.
17. General
These Terms, together with the privacy policy and refund policy, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Not enforcing a provision isn’t a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition, or sale of assets, with notice to you. We aren’t responsible for delays or failures caused by events beyond our reasonable control.
